Momentyx (ABN 42 263 251 849) respects your privacy and takes reasonable steps to protect the personal information it collects. This policy explains how information is handled when you visit this website, contact the studio or enquire about services, including how artificial intelligence is used in that process.

1. Information we collect

We may collect:

  • Your name, business name and contact details
  • Email address and telephone number
  • Information submitted through enquiry forms
  • Information about your website, project or business requirements
  • Communications between you and Momentyx
  • Technical information such as browser type, device, approximate location, IP address and basic website request data
  • Billing and transaction information, where applicable

Please do not provide sensitive information unless it is reasonably necessary and we have requested it.

2. How information is collected

We may collect information when you:

  • Arrange a consultation or discuss a proposed project

Some technical information is recorded automatically by the infrastructure that serves this website. The site is hosted on Cloudflare Pages, and Cloudflare records standard request data such as IP address, browser type and the pages requested, for the purposes of delivering the site, security and abuse prevention.

We may also collect publicly available business contact details when researching prospective clients, as described in section 6.

3. Why we collect information

We may use your information to:

  • Respond to enquiries
  • Prepare proposals and quotations
  • Provide and improve our services
  • Communicate about projects and accounts
  • Maintain business and financial records
  • Protect our website and systems
  • Meet legal or regulatory obligations

We will not sell or rent your personal information.

4. Disclosure to third parties

We may disclose information to service providers that assist with website hosting, communications, forms, project management, invoicing, payments, artificial intelligence processing or data storage. Two providers are involved in the operation of this website:

  • Formspree — processes submissions made through the contact form and delivers them to our email inbox. Formspree is based in the United States and form submissions are processed on its infrastructure.
  • Cloudflare — hosts and delivers this website through its global network, and records standard technical request data as described above.

Artificial intelligence providers are addressed separately in section 5.

Some providers may store or process information outside Australia, including in the United States or other locations where their infrastructure operates. Their handling of information is governed by their own privacy policies.

We may also disclose information where required by law, to protect our legal rights, or with your consent.

5. Artificial intelligence and automated processing

Momentyx uses artificial intelligence tools as a normal part of how it works. This includes drafting and reviewing code and written content, preparing proposals, summarising enquiries and correspondence, researching prospective clients, and building automated systems that are delivered to clients.

This means information you provide may be processed by third-party AI services. Depending on the task, that can include your name and contact details, the content of your enquiry or emails, information about your business and project, and material you send us during a build. Where a project involves us configuring a system that handles your own customers' information, that is dealt with separately in the service agreement for that project.

We use AI providers whose terms state that business or API customer inputs are not used to train their public models. We share only what is reasonably necessary for the task, and we do not use AI to make decisions that have a legal or similarly significant effect on you without a person reviewing them. All work produced with AI assistance is reviewed by a person before it is delivered.

Overseas processing. The AI providers we use operate outside Australia, principally in the United States, and may process information on infrastructure in other countries where their services run. By providing information to us you acknowledge it may be processed overseas in this way. Their handling of information is governed by their own privacy terms.

If you would prefer that particular information is not processed using AI tools, tell us in writing and we will confirm whether we can accommodate that for your project.

6. Outbound contact and marketing

Momentyx may contact businesses that have not previously dealt with us, by email, message or telephone, to introduce our services. We may collect publicly available business contact details for this purpose, from sources such as business websites, public directories and public social-media profiles.

These communications may be researched, drafted, sent or placed using AI-assisted systems, including automated voice systems. Where a call is handled by an automated system, that will be made clear at the start of the call, and you may ask to speak with or be called back by a person at any time. Calls are not recorded without consent.

All outbound contact identifies Momentyx and provides a working way to opt out or unsubscribe. We comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth), and telephone numbers are checked against the Do Not Call Register where required. If you ask not to be contacted again, we keep a minimal record of that request so the request can be honoured.

7. Cookies and analytics

Momentyx does not run analytics software, advertising trackers or marketing pixels on this website, and does not set cookies to profile visitors or follow them across the web.

Our hosting and form providers may use cookies or similar technologies where these are necessary for security, abuse prevention or the correct functioning of a page — for example, while a form submission is being processed. You can restrict cookies through your browser settings, although parts of the website may not operate correctly if you do.

If analytics or other measurement tools are added in future, this policy will be updated before they are used.

8. Storage and security

We take reasonable administrative and technical measures to protect information against loss, misuse, unauthorised access or disclosure.

However, no internet transmission or electronic storage system is completely secure, and absolute security cannot be guaranteed.

We retain information only for as long as reasonably required for business, contractual, taxation, dispute-resolution or legal purposes.

9. Access and correction

You may request access to personal information we hold about you, or ask us to correct inaccurate information. We may need to verify your identity before processing a request.

10. Complaints

If you believe your information has been mishandled, contact us using the details below. We will review your complaint and aim to respond within a reasonable period.

If the Australian Privacy Act 1988 applies and you are dissatisfied with our response, you may be entitled to contact the Office of the Australian Information Commissioner at oaic.gov.au.
